1. TERMS AND CONDITIONS

1. About these Terms
These Terms and Conditions govern tutoring, workshops, consultations, subscriptions, digital products and related educational services supplied by Joyful Tutors Ltd.
Joyful Tutors Ltd is a private limited company incorporated in England and Wales under company number 15262066. Our registered office is 71-75 Shelton Street, Covent Garden, London, United Kingdom, WC2H 9JQ. This is a registered office only and is not a tutoring venue or customer-facing office.

By booking, purchasing or using our services, the customer agrees to these Terms. The customer must be at least 18 years old. A parent, guardian or authorised adult must arrange services for a child.
2. Our services
We primarily provide online tutoring. We may also provide group classes, workshops, events, consultations, lesson packages, subscriptions, digital resources, courses, games and occasional in-person services.
The exact service, tutor, subject, schedule, price and any specific conditions will be confirmed in writing, by email, in a proposal, through TutorCruncher or through another approved booking route.
3. Contracting parties and tutors
The customer contracts with Joyful Tutors Ltd, not directly with an individual tutor.
Tutors are normally self-employed contractors engaged by Joyful Tutors Ltd. We select and allocate tutors, administer the service and remain the customer’s contractual point of contact.
We may change the allocated tutor where reasonably necessary, including because of availability, suitability, illness, safeguarding, quality or operational reasons. We will aim to communicate any change promptly and provide a suitable alternative where possible.
4. Information provided by customers
Customers must provide accurate, current and complete information relevant to the service, including the student’s year group, subject, academic level, goals, availability, learning needs and any relevant safeguarding or reasonable-adjustment information.
Customers must tell us promptly if information changes.
We may rely on information supplied by the customer when matching tutors and planning support. We are not responsible for problems caused by materially inaccurate or withheld information.
5. Prices
Prices may be communicated by telephone, email, written proposal, invoice, TutorCruncher or another approved method.
Unless expressly stated otherwise, prices do not include any tax that becomes legally chargeable in the future. Joyful Tutors Ltd is not currently described as VAT registered. If this changes, any applicable VAT will be communicated clearly and shown on invoices.
We may change prices by giving at least one month’s notice to existing customers. Prepaid packages already purchased will retain the agreed price until the package is used or expires.
6. Payment
Invoices are payable within seven calendar days of the invoice date unless a different deadline is stated in writing.
Payment may be made by approved electronic payment method, bank transfer or online payment facility.
If payment is late, we may
send reminders;
suspend future lessons, access or bookings;
decline further bookings;
recover reasonable costs incurred in pursuing overdue sums; and
terminate the service where non-payment continues.
The customer remains responsible for fees properly due for services already supplied.
7. Packages and lesson credits
Unless a different expiry date is stated when sold, prepaid lesson packages and credits expire six months after purchase.
Unused credits have no cash value except where a refund is required by law or expressly agreed under our Cancellation and Refund Policy.
Customers should use credits before expiry. We may extend an expiry date at our discretion in exceptional circumstances.
8. Scheduling and attendance
Lessons will be arranged through TutorCruncher or another approved communication method.
Customers must ensure that the student
attends on time;
has a suitable device and reliable internet connection for online lessons;
has required materials;
is in a safe and appropriate learning environment; and
behaves respectfully.
For children, a parent, guardian or responsible adult must remain contactable during the lesson. Younger students should be appropriately supervised nearby.
If a student is late, the lesson will normally still finish at the scheduled time.
If a student does not attend, the tutor will make reasonable efforts to contact the customer through an approved route. The tutor will normally wait for up to 20 minutes. The lesson may then be treated as a missed lesson and charged in full.
9. Cancellations and rescheduling
Individual lessons require at least 24 hours’ notice to cancel or reschedule.
Where less than 24 hours’ notice is given, the full lesson fee may be charged or the relevant lesson credit may be used.
We may exercise discretion for a genuine and exceptional emergency where sufficient explanation is provided. Discretion is not guaranteed and repeated late cancellations may still be charged.

10. Tutor cancellations
If a tutor cancels, we will normally offer a replacement lesson.
Where a replacement cannot reasonably be arranged, we may provide a lesson credit or refund for the affected lesson.
We are not liable for indirect losses resulting from a tutor cancellation, but this does not limit rights that cannot legally be excluded.
11. Ending recurring tutoring
A customer must give at least seven days’ written notice to end a recurring tutoring arrangement.
This notice requirement is separate from the 24-hour rule for cancelling an individual scheduled lesson.
We may end or suspend services immediately where reasonably necessary because of
non-payment;
abusive, threatening or discriminatory conduct;
safeguarding concerns;
repeated absence or disruption;
harassment of a tutor, student or staff member;
serious or repeated breach of these Terms;
misuse of systems or resources; or
attempts to engage a tutor privately in breach of section 20.
If we end services without fault by the customer, we will refund unused prepaid fees for services not supplied, subject to any lawful deductions.
12. Parent, guardian and adult-student responsibilities
The customer must
arrange services for a child through a parent, guardian or authorised adult;
provide accurate information;
remain reasonably contactable;
ensure a safe and appropriate learning environment;
supervise younger children where appropriate;
support respectful behaviour;
notify us of relevant learning, health, disability or safeguarding needs;
maintain suitable equipment and internet access; and
comply with reasonable safeguarding and platform instructions.
13. Communication with students
Communication involving a child should normally take place through a group chat or channel that includes the parent or guardian and, where appropriate, Joyful Tutors Ltd.
Tutors and students must not engage in private or secret communication outside approved arrangements.
Approved platforms may include TutorCruncher, Zoom, Google Meet, Microsoft Teams, WhatsApp, email or another platform expressly approved by Joyful Tutors Ltd for the service.
14. Conduct and safety
The following are prohibited
abusive, threatening, discriminatory or inappropriate behaviour;
sexualised, secretive or boundary-crossing communication;
recording lessons without written authorisation;
sharing private tutor or student contact details publicly;
photographing or filming a child without proper permission;
attempts to obtain services dishonestly;
plagiarism, cheating or academic misconduct; and
attempts to bypass Joyful Tutors Ltd and hire a tutor privately.
We may suspend or terminate services immediately where conduct creates a safeguarding, legal, reputational or operational risk.
15. Academic integrity
Tutors may explain, guide, model, review and support homework or coursework.
Tutors will not complete assessed work, examinations, controlled assessments or applications on behalf of a student.
Students must not use tutoring, resources or artificial intelligence to plagiarise, cheat, misrepresent authorship or breach school, examination-board or institutional rules.
16. Academic outcomes
We will use reasonable care and skill in providing services.
However, we do not guarantee
particular grades;
examination results;
school or university admission;
7+, 11+ or entrance-examination success;
scholarship awards;
predicted-grade changes; or
any specific academic outcome.
Results depend on many factors outside our control, including attendance, effort, school provision, health, assessment conditions and official decision-making.
17. Official requirements and deadlines
Parents, guardians, adult students and relevant institutions remain responsible for checking:
examination-board requirements;
exam entry;
registration and application deadlines;
school admissions rules;
university applications;
official results;
appeals; and
any legal or institutional requirements.
Tutors may provide educational guidance, but this does not replace official advice from the relevant school, examination board, admissions body or institution.
18. Resources and intellectual property
All rights in materials created or supplied by Joyful Tutors Ltd or its tutors remain with the relevant owner.
This includes
worksheets;
lesson resources;
digital downloads;
courses;
games;
lesson systems;
branding;
website content;
videos;
graphics; and
educational frameworks.
Customers receive a limited, personal, non-transferable licence to use supplied materials for the student’s own learning.
Materials must not be copied, sold, published, uploaded, shared commercially, distributed to others or used to train an AI system without written permission.
19. Digital products, subscriptions and accounts
Digital products and subscriptions are licensed for personal use by the purchasing household unless expressly stated otherwise.
Access must not be
resold;
shared publicly;
transferred outside the purchasing household;
used commercially; or
shared in a way that undermines access controls.
We may suspend access for misuse, security concerns, non-payment or breach of these Terms.
Specific product terms may also apply and will be shown before purchase.
20. Non-circumvention
A customer must not directly or indirectly engage, employ, contract with or pay a tutor introduced through Joyful Tutors Ltd outside our service without our prior written consent during the tutoring relationship and for 12 months after the tutor’s final lesson or introduction.
This restriction protects our legitimate interest in tutor recruitment, matching, administration and client acquisition.
If this section is breached, we may seek recovery of reasonable losses actually caused by the breach. This section is not intended to impose a penalty or restrict lawful rights more widely than reasonably necessary.
21. Consumer cancellation rights
Where a consumer enters a distance or off-premises contract, a statutory 14-day cancellation period may apply.
If the customer asks us to begin a service during that period, the customer must expressly request the early start. If the customer then cancels within the cooling-off period, the customer may have to pay a proportionate amount for services supplied before cancellation.
Where a service has been fully performed during the cancellation period after the customer expressly requested early performance and acknowledged the consequence, the cancellation right may be lost where the law permits.
For digital content, the cancellation right may be lost once supply begins where the customer expressly consents to immediate access and acknowledges that the right will be lost, where legally permitted.
Nothing in these Terms removes statutory consumer rights.
22. Data protection
We process personal information in accordance with our Privacy Notice and Cookie Notice.
Customers should avoid sending unnecessary sensitive information through insecure channels.
23. Liability
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
Subject to that
we are not liable for losses that were not reasonably foreseeable when the contract was made;
we are not liable for loss caused by inaccurate information, missed deadlines, third-party systems, internet failure or circumstances outside our reasonable control;
we are not liable for business losses suffered by consumers; and
where services are purchased for business purposes, additional written terms may apply.
Any limitation will be applied only to the extent permitted by law.
24. Events outside our reasonable control
We are not responsible for delay or failure caused by circumstances outside our reasonable control, including internet outages, platform failures, illness, emergencies, severe weather, public-health events, industrial action or government restrictions.
We will take reasonable steps to minimise disruption.
25. Changes to services or Terms
We may update services, systems and these Terms for legal, regulatory, safeguarding, technical or operational reasons.
Material changes affecting existing customers will be communicated with reasonable notice where appropriate.
26. Complaints
Complaints should be made under our Complaints Procedure by emailing hello@joyfultutors.com.
Safeguarding concerns should be reported immediately to the Designated Safeguarding Lead.
27. Governing law and courts
These Terms are governed by the law of England and Wales.
Consumers living elsewhere in the United Kingdom or another country may also have mandatory rights under the law of their place of residence.
The courts of England and Wales will have jurisdiction, subject to any mandatory consumer right to bring proceedings elsewhere.
